1. Introduction
Welcome to Deja Marc (“Deja Marc Aus”, “we”, “our”, “us”). These Terms and Conditions (“Terms”) apply to all purchases and use of our website, services, mobile programs, and products. By accessing or using our website or purchasing from us, you agree to be bound by these Terms.
These Terms incorporate your rights under the Australian Consumer Law (ACL), which provides statutory guarantees that cannot be excluded. Nothing in these Terms is intended to override your rights under the ACL.
2. Our Products
All jewellery is custom-made, personalised, and made to order.
Images on our website are for illustration only. Actual products may vary slightly due to natural variations in metals, engraving detail, and finishes.
Personalisation details are provided by you at the time of order. Please ensure accuracy, as we cannot be held responsible for errors submitted by you.
3. Pricing & Payment
All prices are listed in AUD unless otherwise stated.
We reserve the right to change pricing at any time without notice, except where you have already placed an order.
Payment must be received in full prior to production or dispatch.
4. Shipping & Delivery
We ship within Australia and internationally. Estimated delivery times are provided but not guaranteed.
Risk in the goods passes to you upon delivery. Title remains with Deja Marc until payment is received in full.
Customs duties, taxes, and import fees are the responsibility of the purchaser.

5. Returns & Exchanges
Due to the personalised nature of our jewellery, we cannot accept returns or exchanges for change of mind. However, under the ACL, you are entitled to a repair, replacement, or refund where the product:
- Has a major fault, defect, or failure; or
- Does not match its description or intended purpose.

6. Warranty
We stand by the quality of our craftsmanship. Your jewellery is covered by a 6-month craftsmanship warranty from the date of receipt.
This warranty covers structural integrity (broken chains, faulty clasps, loose settings), but does not cover:
- Normal wear and tear (scratches, fading, dents, tarnish).
- Damage caused by misuse, accidents, or improper care (including exposure to chemicals, swimming, or cleaning agents).
- Wearing multiple pendants on one chain or stacking charms with other jewellery, as this may cause scratching or damage to engravings. Such use is not covered by our warranty.

7. Jewellery Care
To preserve the longevity of your jewellery, we suggest following our jewellery care guide closely. You can view this here.
8. Gift Cards & Fingerprint Kits
Gift cards are non-refundable and non-transferable. You can read more about our gift card policy here.
Fingerprint kits are provided as part of your order. Any replacement kits incur a fee of $10.00 AUD. Delays in returning kits may delay production timelines.
9. Intellectual Property
All content on our website, including photographs, copy, product designs, and trademarks, is the intellectual property of Deja Marc. You may not reproduce, distribute, or use our content without prior written consent.
10. Liability
To the fullest extent permitted by law:
We are not liable for any indirect, incidental, or consequential damages.
Our liability for any breach of the ACL consumer guarantees is limited to repair, replacement, or refund as required by law.
11. Privacy
We respect your privacy and handle all personal data in accordance with our Privacy Policy.
12. Mobile Terms of Service
The Deja Marc Aus mobile message service (the “Service”) is operated by Deja Marc. By using the Service, you agree to these Mobile Terms.
By consenting, you agree to receive recurring SMS/text messages from Deja Marc to the mobile number you provide, even if on a Do Not Call list.
Messages may include promotions, cart reminders, or other marketing offers. Consent is not a condition of purchase.
We do not charge for the Service, but message/data rates may apply. Frequency varies.
You may opt out anytime by texting STOP to DejaMarc or clicking the unsubscribe link. A one-time confirmation message will be sent.

We may change short codes/numbers used to deliver the Service. We are not responsible for undelivered messages or if you fail to update your mobile number.
Wireless carriers are not liable for delayed or undelivered messages.

We may update these Terms at any time. The latest version will always be available on our website, and the “last updated” date will reflect changes.
14. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
